Terms and Conditions of Sale
Article 1 – General terms and conditions
These terms and conditions are entered into between SAS EMLA, registered with the Créteil Trade and Companies Register under number 933 080 301, VAT number FR74 933080301 (hereinafter "EMLA"), and any individual or legal entity wishing to make a purchase via the website emlaparis.com (hereinafter "the buyer").
Article 2 – Purpose
These terms define the contractual relationship between EMLA and the buyer, and apply to all purchases made via www.emlaparis.com, whether the buyer is a professional or a consumer.
Any order placed implies full acceptance of these terms. They prevail over any other conditions not expressly accepted by EMLA.
EMLA reserves the right to modify these terms at any time; the applicable terms are those in force at the date of the order.
Article 3 – Product characteristics
Products offered are those listed on the website, subject to availability. Each product is described by the supplier. Photos are as accurate as possible but cannot guarantee perfect similarity, particularly regarding colors.
Article 4 – Prices
Prices are displayed in euros, pounds, and dollars. Prices in euros include all taxes (TTC) and are applicable at the time of order. Any VAT change may be reflected in prices.
EMLA reserves the right to change prices at any time, but the price at the time of order remains applicable. Prices exclude processing, transport, and delivery costs unless stated otherwise.
Article 5 – Geographic area
Online sales are available for mainland France, the European Union, and international destinations.
Article 6 – Orders
To place an order, the buyer must:
- Complete the identification form
- Fill in the online order form
- Verify and confirm the order
- Make payment
- Confirm payment
Order confirmation implies acceptance of these terms. All recorded data constitutes proof of the transaction. A confirmation email will be sent.
Article 7 – Right of withdrawal
Consumers have 14 days from delivery to return products for exchange or refund, without penalty except return shipping costs.
Article 8 – Payment
Payment is due upon ordering via secure platforms: PayPal and Shopify Payments.
The buyer is charged only for shipped products. An invoice can be provided upon request.
Article 9 – Delivery
Delivery is made to the address provided. Risk transfers upon shipment. Any damage must be reported to the carrier within 3 days.
Delivery times are indicative. If exceeding 30 days, the buyer may cancel and request a refund.
Article 10 – Returns
All products benefit from legal guarantees. Non-compliant items may be returned for exchange or refund.
Claims must be made within 14 days via email: contact@emla.fr
Return conditions:
- Unworn, unwashed, undamaged
- In original packaging
- Prior request by email
Refunds are processed within 3–4 business days after validation.
Article 11 – Liability
EMLA is bound by a best-efforts obligation. It is not liable for damages related to internet use (data loss, viruses, etc.).
Article 12 – Intellectual property
All website elements are the exclusive property of EMLA. Any reproduction is strictly prohibited without prior written consent.
Article 13 – Personal data
In accordance with data protection laws, personal data may be processed. EMLA may collect data and share it with partners. Buyers have rights of access, correction, and opposition.
Article 14 – Archiving and proof
Orders and invoices are stored as reliable records. EMLA's digital records serve as proof of transactions.
Article 15 – Disputes
These terms are governed by French law. In case of dispute, jurisdiction is assigned to the courts of Paris.
